I'll defer to consensus, but it seems liek a pure geometric pattern to me. There is no affirmative release on teh website, but there is no copyright claim on the work, and assuming it qualifies as PD-shape then an affirmative release is not necessary. The SJSU website offers the free download.

This might qualify for {{PD-CAGov}}, although I don't know exactly how universities are governed in the United States.
Page 1 of
this file contains two logos: one {{PD-textlogo}}, and one {{Non-free logo}}. This logo is possibly more complex than both of those, although this is a matter of discussion. In either case, the situation is unclear, so we have to assume that the logo is unfree. --

If you're saying that you think this is more than a geometric pattern, then I'll take that at face value. But I take issue with "assuming" anything. No wiki image is assumed invalid once it has a claim of use. If there is a consensus that the claim of use is wrong, then delete it.

Permission is not an issue when the claim of use/tag is "PD-text". There can be no permission because there is no copyright. That being said, I'd insist on a source for the logo.
