Derivative of a copyrighted work, not eligible for Freedom of Panorama. –DMartin 06:13, 4 March 2023 (UTC) reply

The sculpture is permanently located in a public space in a state funded institution. The sculpture is clearly visible from the street—-although I took the image from the interior of the building when I was a faculty member at the college. The sculpture and the derivative image DO meet the threshold for Freedom of Panorama photographs.
Freedom of panorama (FOP) is a provision in the copyright laws of various jurisdictions that permits taking photographs and video footage and creating other images (such as paintings) of buildings and sometimes sculptures and other art works which are permanently located in a public place, without infringing on any copyright that may otherwise subsist in such works, and the publishing of such images. From the FOP page on commons:

"For artworks, even if permanently installed in public places, the US copyright law has no [freedom of panorama] exception, and any publication of an image of a copyrighted artwork thus is subject to the approval of the copyright holder of the artwork. However, public artwork installed before 1928 is considered to be public domain, and can be photographed freely. In addition, any public artwork installed before 1978 without a copyright notice is also in the public domain (unless the copyright owner actively prevented anyone from copying or photographing the work until 1978). In these situations, document the date of installation and the creator (sculptor) of the pictured work as much as possible."

While I don't know the exact date of the installation, I suspect it was well into the 21st century, and therfore a derivitive work of it would not be permitted on Wikipedia.

The file is the investigation report's cover for the Ladbroke Grove rail crash by the UK Government, depicting the scene of the accident. However, {{ Ir-Crown-UK}} mandates that it is only intended to illustrate the object in question, which would be the report itself instead of the accident, and neither the usage of {{ Non-free book cover}} is appropriate for using the entire report cover.

Even if the file is further cropped, as the crash occurred due to improper signalling, a crash scene fails to explain the accident's reasons and root cause. The file only serves as a visual illustration of the accident, and lacks contextual significance — a quote from the report would be much more useful in this case. Its omission would not be detrimental to the understanding of the article.

Finally, as an UK Government work, while it was published under all rights reserved crown copyright, there is still a chance that the UK Government may relicense it into free licenses like {{ OGL}} (as long as the cover image is also a UK Government work instead from other sources), thus eliminating the need of fair use.

The file therefore violates WP:NFCC#1, WP:NFCC#8 and WP:NFC#UUI point 9, and should be deleted. 廣九直通車 ( talk) 09:44, 4 March 2023 (UTC) reply
