We already have a free image of Devito File:Danny DeVito by Gage Skidmore.jpg looking pretty much just like this in-character shot. Similar shirt, similar glasses, same hairstyle. Fails WP:NFCC#8 in that there is no contextual significance for including this image. The fair use rationale states that its purpose is to "describe characters" when a) only one character is depicted in the image and b) there are other, more important characters that are not depicted.
