I think that the claim that the term was coined so recently is clearly erroneous, and I would suggest that its broader use needs to be acknowledged, even while keeping the focus on this particular use of the term. Wbehun ( talk) 04:42, 8 November 2010 (UTC) reply

I agree. For instance, Randy Barnett has used the term to describe a sort of blending of legal positivism and natural law theory. See here, which was published in 1978, whereas Olufemi Taiwo's book appears to have been published originally in 1996. Orthzar ( talk) 19:48, 15 December 2012 (UTC) reply
