The 1940 Constitution of Cuba, was implemented in 1940, during the presidency of Batista.
While it is true that Batista was a major, if not "the," power in Cuba from 1934 -1944, he was not President of Cuba until 10-20-1940. This Constitution came into effect in 7/1940 under Federico Laredo Brú's Presidency. At the very least, some clarification is required in the wording of this article.

The Constitution of 1940 was suspended in January, 1959
There was a national election
1958 Cuban general election by the People of Cuba who elected
Andrés Rivero Agüero. The inconvenient truth is that the self appointed "new government", not Batista, were the ones that overthrew a dully elected government and the Constitution of 1940.
